Terms of Service

Important
CNFRMD may modify features, calculations, AI recommendations, and any part of the platform at any time and without prior notice to keep the Services working appropriately. Please read Section “Site Changes and Ongoing Improvements” below.
These Terms of Service (“Terms”) govern your access to and use of the CNFRMD LLC website, mobile experience, waitlist, and related services (collectively, the “Services”). By creating an account, checking the acceptance box, or using the Services in any way, you agree to these Terms and the Privacy Policy referenced below.
Site Changes and Ongoing Improvements
CNFRMD may modify, update, add, remove, or reconfigure any part of the Services — including features, calculations, AI recommendations, UI, copy, and data flows — at any time and without prior notice in order to keep the platform working appropriately, secure, and aligned with our roadmap. Some changes may be rolled out to only a subset of users. Your continued use of the Services after any change constitutes acceptance of the change.
1. Eligibility
You must be at least 16 years old and legally capable of entering a binding contract. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Acceptance and Terms Updates
The acceptance checkbox at signup is mandatory. You may not create an account or continue using the Services without accepting the current Terms and Privacy Policy. We record the date, time, version, your user ID, IP address (when available), and device information at the moment of acceptance for audit purposes.
If we materially update these Terms, we will present the updated version and require you to accept the new version before continuing to access the platform.
3. The Services
CNFRMD provides a collaborative group travel planning platform that organizes trip details, produces the Travelarity™ Trip Confidence Score, and coordinates group logistics. Full booking capabilities may be added in future releases.
4. Accounts and Security
You are responsible for the security of any credentials used to access the Services and for all activity under your account. You must notify us immediately of any unauthorized access at hello@itscnfrmd.com.
5. Acceptable Use
You agree not to:
- Use the Services for unlawful, harmful, or fraudulent activity.
- Attempt to breach security, disrupt operations, reverse engineer, or scrape the Services.
- Upload content that is defamatory, infringing, or violates the rights of others.
- Impersonate any person or entity, or misrepresent affiliation.
- Use the Services to send spam or unsolicited communications.
6. Travelarity™ Methodology
Travelarity™ is designed to provide insights into travel preferences and coordination. Travelarity™ is not intended to diagnose, label, predict, or classify any individual.
Travelarity™ should not be interpreted as medical, psychological, or professional advice. Travelarity™ scores are intended solely to support trip planning and group compatibility insights.
CNFRMD makes no guarantees regarding compatibility, trip outcomes, or travel experiences. Results are informational only.
6a. Travelarity™ Intellectual Property and Licensing
Travelarity™, including its underlying methodology, framework, questionnaire, scoring model, type taxonomy, and associated brand marks, is the exclusive intellectual property of Jocelyne Martin. All rights, title, and interest in and to the Travelarity™ methodology remain with Jocelyne Martin.
CNFRMD LLC operates the Travelarity™ methodology on this platform under a written leasing agreement with Jocelyne Martin, which grants CNFRMD LLC the right to implement, display, and apply the Travelarity™ methodology within the CNFRMD Services. This leasing agreement does not transfer ownership of Travelarity™ to CNFRMD LLC.
You may not copy, reverse engineer, republish, redistribute, sublicense, or create derivative works based on the Travelarity™ methodology, questions, scoring logic, or type framework without the express written consent of Jocelyne Martin. Any unauthorized use of the Travelarity™ methodology is a violation of these Terms and of applicable intellectual property law.
7. Compatibility and Privacy of Answers
Individual Travelarity™ answers remain private. Individual question responses are never shared with other users. Only aggregated compatibility calculations and group compatibility scores may be shared to support the Travelarity™ Methodology.
Every profile field also has a per-field visibility setting (Only Me, Host Only, Group Members, or Do Not Share). Nothing sensitive is shared by default; you decide what is shared and with whom.
8. Data Collection Consent
You acknowledge and consent that CNFRMD collects information necessary to provide platform services. Information may be viewed by:
- Authorized CNFRMD personnel;
- Authorized Hosts (only where you have granted permission);
- Authorized Group Members (only where you have granted permission);
- Service providers necessary for platform operation.
9. Host Permissions
Hosts will only see information that travelers have explicitly allowed them to view. Co-hosts inherit permissions only when granted by the Host. Group members will only view information explicitly shared with the group. No sensitive information is visible by default.
10. Third-Party Services
CNFRMD integrates with third-party platforms including but not limited to hosting providers, communication services, payment processors, analytics providers, AI providers, travel suppliers, and other embedded services. These providers may collect or process information according to their own Terms of Service and Privacy Policies.
CNFRMD is not responsible for the privacy practices, security, availability, or content of third-party services. Users acknowledge and accept these third-party relationships by using the platform.
11. User Content and Intellectual Property
You retain ownership of the content you submit (“User Content”). You grant CNFRMD a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display User Content solely to operate and improve the Services. The Services, including all software, text, graphics, and trademarks, are the exclusive property of CNFRMD or its licensors.
12. Beta / Pre-Release
Beta features may be unstable, unsupported, or discontinued at any time. They are provided “as is”. Feedback you provide about the Services may be used by CNFRMD without restriction or compensation.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CNFRMD DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CNFRMD AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID CNFRMD IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
15. Indemnification
You agree to indemnify and hold CNFRMD harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Services.
16. User Rights
You have the right to:
- Access your data;
- Correct inaccurate information;
- Delete your account;
- Request a copy of your information;
- Withdraw consent where legally applicable.
Deleting an account permanently removes personal information except where retention is required by law. Use our self-serve data page to exercise these rights.
17. Termination
We may suspend or terminate access at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases. Sections 6-15 survive termination.
18. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing in this section prevents either party from seeking equitable relief.
19. Inclusive Language Statement
CNFRMD welcomes travelers of every background, identity, and experience. For readability within these Terms, traditional pronouns such as “he,” “she,” “his,” or “hers” may occasionally be used. These references are intended solely for readability and are not intended to exclude, misidentify, or diminish any individual’s gender identity, gender expression, or preferred pronouns.
20. Changes to these Terms
We may modify these Terms. If we make material changes, we will notify you by updating the version, updating the effective date, and requiring re-acceptance before continued use of the platform.
